
This morning, six retired corrections officials, including Dr. Allen Ault, retired Director of the Georgia Department of Corrections and former Warden of the Georgia Diagnostic and Classification Prison where he oversaw executions for the state, have sent the following letter to Georgia Corrections Officials and Governor Nathan Deal asking them to urge the Georgia Board of Pardons and Paroles to reconsider the decision they made on Tuesday, September 20, 2011 to deny Troy Davis Clemency despite concerns about his guilt.
Statement:
We write to you as former wardens and corrections officials who have had direct involvement in executions. Like few others in this country, we understand that you have a job to do in carrying out the lawful orders of the judiciary. We also understand, from our own personal experiences, the awful lifelong repercussions that come from participating in the execution of prisoners. While most of the prisoners whose executions we participated in accepted responsibility for the crimes for which they were punished, some of us have also executed prisoners who maintained their innocence until the end. It is those cases that are most haunting to an executioner.
We write to you today with the overwhelming concern that an innocent person could be executed in Georgia tonight. We know the legal process has exhausted itself in the case of Troy Anthony Davis, and yet, doubt about his guilt remains. This very fact will have an irreversible and damaging impact on your staff. Many people of significant standing share these concerns, including, notably, William Sessions, Director of the FBI under President Ronald Reagan.
Living with the nightmares is something that we know from experience. No one has the right to ask a public servant to take on a lifelong sentence of nagging doubt, and for some of us, shame and guilt. Should our justice system be causing so much harm to so many people when there is an alternative?
We urge you to ask the Georgia Board of Pardons and Paroles to reconsider their decision. Should that fail, we urge you to unburden yourselves and your staff from the pain of participating in such a questionable execution to the extent possible by allowing any personnel so inclined to opt-out of activities related to the execution of Troy Anthony Davis. Further, we urge you to provide appropriate counseling to personnel who do choose to perform their job functions related to the execution. If we may be of assistance to you moving forward, please do not hesitate to call upon any of us.

I didn’t really kept abreast with this case but from what I am reading now and from the unanimous support of the public it’s a sad sad time. If this man is really innocent I can only imagine how his family is feeling now. My prayers go out to them.

“A Lifelong Sentence of Nagging Doubt.” Couldn’t have put it any better. This is why I don’t support the notion of the death penalty. There is always the “what if ” scenario. That sliver of doubt should be enough to give the powers that be pause. If an innocent human being is lost due to the death penalty; it does not make for a great nights sleep for those with a conscience who had the power to stop it.

a friend who’s a lawyer says that SCOTUS delay is just a tactic to ensure police has response needed after the execution takes place. It would definitely explain the increase in police presence and the riot police.

I’m a lawyer and I think that’s pretty cynical. The Supremes had issues to deliberate, which I’m sure they took their time with. Cops have been there all day already. Cops are increasing because, naturally, the longer this was strung out, the more the people’s feelings would grow more sensitive.
SCOTUS refused the stay. My friend may have been cynical, but it this case I think he may have been right.

There were no dissents. Now I’m wondering what kind of case they presented.
The reporter guy said sometimes they dissent, sometimes they don’t. There may not have been time for the dissent to get something in writing. They need 5 voters to stay the execution.

From what I recall, no dissents mean none were written, not that no one dissented. In any event, we don’t know the vote breakdown. I’m just going to breathe through it…..I really hate the our media though. They love sensationalism.

If anything, since PBO’s been elected, I feel the deterioration of all gains made, and that affects the entire nation. They’re gathering everyone needed in the room for the excecution. The McPhail family, Troy’s family and others. The execution will take place in 20-30 minutes. It seems like the Supreme Court was giving the Georgia police time to gather about 100 police and swat teams so that if any protests broke out, they could stop it.

The NBC reporter on the scene says he has confirmed the execution will take place within an hour, possibly within a half hour. God bless everyone involved … I hope the people outside remain calm, if at all possible, so they don’t get hurt.

No it is NOT appropriate for the WH to weigh in. This man has been on death row for 20 years, and he has come close to being executed on more than one occasion before Obama was elected, yet no one required or asked Bush 41, Clinton or Bush 43 to weigh in. It is tremendously unfair and inappropriate to require that President Obama “weigh in” on this issue – why? Just because he’s a Black President? And even if the President weighs in, it will not have any real benefit to Mr. Davis or anyone else involved.
Furthermore, this is ultimately the state of Georgia’s decision, not the SCOTUS. Do you realize that the state could still have gone ahead and executed Mr. Davis even while they were supposedly waiting for a decision? The decision did not rest with the SCOTUS.
I’m really pissed at this. I don’t blame the family, I blame CNN they are using this woman for ratings and sensationalism…freakin’ bastards.

For comfort, I looked for the words Robert F. Kennedy spoke on April 4, 1968, a different time and place and event – but strikingly similar relating to man’s inhumanity to man. Among his words:

Jeffery Toobin on CNN said that the fact that is was with no dissent and that there was note of any dissent, means that it was unanaimous(sp??). He said that if it wasn’t then there would have been some note of a dissenter.
Make of that what you will. Is he right?
That’s how I understand it. Unanimous. I just can’t believe that when the Supremes sent his case back for consideration of the new evidence, this wasn’t overturned or at least dropped from being a death penalty case.

I was in the car when the word came at 4:01pm PDT that there was a delay (and that he had received a stay – that later proved false), and I burst into tears. I was so happy I couldn’t belive it.

I feel certain he would not have P. But he could not intervene even though the net is hot with folk blaming him for not doing so. Even the governor was not allowed to do so, and this is the case in 5 states. Wonder how long it will be before most if not all states will become locked down this way.
