AP: The number of people seeking unemployment benefits rose last week to a seasonally adjusted 377,000, up from a nearly four-year low the previous week. But the longer-term trend is pointing to a healthier job market.

Applications have trended down over the past few months. The four week average has declined to 377,500. When applications fall consistently below 375,000, it tends to signal that hiring is strong enough to lower the unemployment rate. Some economists say the figures suggest further job gains ahead…..

Reuters: New orders for manufactured goods rose in December and a gauge of future business investment rebounded, while new claims for jobless benefits rose only moderately last week, suggesting the labor market was still healing.

Durable goods orders climbed 3.0 percent, the Commerce Department said on Thursday. Economists had forecast orders rising 2.0 percent …. Orders last month were buoyed by 5.5 percent increase in bookings for transportation equipment as orders for civilian aircraft surged 18.9 percent….

“What it does tell you about going into the new year is that there’s some momentum here,” said Jacob Oubina, an economist at RBC Capital Markets in New York.

        Brewer suspected of DUI in 1988 crash; case not pursued

        The Republic obtained state Department of Public Safety records describing a 1988 car crash involving Jan Brewer, who was then a state senator.

        AZ Fact Check looked at several issues in those documents, including whether Brewer was at fault in an alcohol-related crash and whether she received special treatment.

        Brewer confirmed the basic details of the crash, as did the widow of the man Brewer hit. The DPS has not reproduced the records; The Republic obtained the records from another source.

        WHAT WE’RE LOOKING AT: Was Brewer involved in an alcohol-related crash, and was she at fault?

        ANALYSIS: On May 4, 1988, a car driven by Brewer rear-ended a van on Interstate 17.

        The van’s driver, William Holland, was not injured in the crash. Brewer also emerged unscathed, though there was significant damage to her car.

        DPS officers at the scene believed Brewer was intoxicated. Unsteady on her feet, her breath smelling of alcohol, Brewer failed a series of field sobriety tests.

        Brewer was placed in handcuffs and taken to a DPS station, where she was supposed to undergo a test to determine her blood-alcohol level. But no test was ever performed. After a discussion with a DPS lieutenant, two officers drove Brewer home.

        At the scene, Brewer told officers she had “one scotch.” Later, at the station, she said she had had two. At the time, she denied being drunk.

        And the case never went to a judge or jury.

        The DPS, after learning that Brewer was a state senator, told her that she had immunity from arrest. No charges were filed in the case. Brewer, who says she remembers the crash vividly, maintains that she was not impaired.

        Brewer told different stories about what led to the crash. She told officers on the scene that a car had rear-ended her, pushing her car into Holland’s, and then driven away.

        But officers found no damage to the back of Brewer’s car, and they noted that a layer of dust on the bumper was undisturbed.

        The next day, Brewer told the Phoenix Gazette that a white truck had swerved in front of Holland, suggesting that he had suddenly braked.

        “I guess I might have been following too closely or something,” she said at the time.

        BOTTOM LINE: Officers at the scene said Brewer was intoxicated, but she denies it. The investigation was halted before they made an official determination. The report says that from the officer’s initial investigation, “it appears that she was the at-fault vehicle as she rear-ended the vehicle in front of her.”

        WHAT WE’RE LOOKING AT: Did Brewer receive special treatment from the DPS, and did she get immunity from prosecution?

        ANALYSIS: According to his widow, Holland called the DPS in the days after the crash to ask whether Brewer would face any consequences. The person he spoke with said that Brewer had immunity from arrest.

        Brewer was released because, according to the arresting officers, she was protected from arrest by her status as a lawmaker in session. Brewer did not ask for immunity, nor did she mention that she was a senator, according to reports.

        “It wasn’t my decision,” Brewer said. “I never asked for legislative immunity.”

        Brewer said lawmakers arrested on charges of “serious” crimes should not be exempt from arrest.

        “We are no different from anybody else in this state,” she said. “We all, I think, are citizen legislators.”

        The Arizona Constitution does exempt lawmakers from arrest during the legislative session – with the exception of cases involving treason, a felony or breach of peace.

        A similar provision exists in the U.S. Constitution. It arose as a way to protect lawmakers from retaliation by political enemies, who might otherwise arrest them on trumped-up charges to keep them away from their duties.

        But charges still could have been filed after the session ended, said Paul Bender, a professor of constitutional law at Arizona State University.

        “Legislative immunity would not justify them in dropping the charges,” Bender said. “It doesn’t say ‘privileged from prosecution.’ ”

        Had she been charged with a DUI involving a crash in which no one was injured, it would have been considered a misdemeanor at the time.

        Generally, the DPS would forward cases to the Maricopa County Attorney’s Office for prosecution. A spokesman for the County Attorney’s Office says it never received a complaint from the DPS.

        DPS officials have not responded to a request for information about the case, including what policies were in effect at the time with regard to arrests of lawmakers and why they did not pursue the case.

        BOTTOM LINE: It appears that officers were right not to arrest Brewer while lawmakers were in session. But it is unclear why officers did not complete their investigation and pursue charges.

        AFTERMATH: In the years since the crash, Brewer has acted repeatedly to increase penalties for DUI offenders.

        As a state senator in 1990 she voted for House Bill 2433, which, among other provisions, required that drivers who were found to be under the influence have their licenses revoked. In 1993, she voted for House Bill 1003, which increased the minimum jail sentence for a first offense from 24 hours to 10 days.

        This year, as governor, she signed Senate Bill 1420. The bill significantly increases penalties for juveniles who violate DUI laws.

        “I think we’ve become more aware that bad things happen when you drink and drive,” Brewer said. “As we become older, we get more responsible. We understand that’s not a good thing. I believe no one should be drinking and driving. And I take it seriously – I took it seriously then, and I certainly take it seriously today.”

        Holland, whose widow said he developed heart problems while serving in the Korean War, died of heart disease less than a year after the crash.

I have 2 days of reading to catch up on because I celebrated my birthday yesterday by hosting an Obama Neighborhood Team phone bank at my house to get out the vote for Suzanne Bonamici, the Democrat running for Wu’s empy seat in Congress (DC 1 in OR). I’d upload a photo if I knew how, but suffice it to say that the delicious photo of smiling PBO in the rain was the decoration on my birthday cake. You were all there in spirit! People are fired up since the State of the Union speech, so I’m hopeful we’ll have another Democratic woman in Congress.

The Obama campaign should run lots of ads in Georgia against this treatment , build an army on the ground and go for a big splash in November.     I keep wondering when we are going to reach a tipping point with the pathological lying of the Republican Party. The feckless media seems to have an aversion to calling a LIE a LIE. If they can’t say BOTH SIDES DO IT they will steer clear of calling out anyone in the GOP. The best proof of this phenomenon was when Norah O’Donnell (CBS) interviewed Newt Gingrich and he said flat out that Mitt Romney was A LIAR. Norah headed straight for the fainting couch. She just could not believe that Newt was actually calling Mitt Romney a liar on the tv. As Steve Benen so aptly put, it was Norah herself who should have been make that point. Anyone with a couple of gray cells knows that Mitt Romney lies with abandon all the time.

    In honor of Rachel Maddow’s awesome takedown of Polififact (what a joke?), today my mission will be to post any many articles as I can documenting the pathological lying of the Republican Party. I am hoping the twitter brigade will do the honors and spread the items far and wide. Seriously, we are at a point now where the GOP members of congress and the presidential candidates just make stuff up and they are rarely if ever challenged about inaccurate or outlandish claims. This is an indictment of the media. They just aren’t doing their job of educating and informing the public with the facts.

    State of the Union speeches can be inspiring when the President lays out a specific agenda for the coming year and gives an honest appraisal of the nation’s progress during the previous year. President Obama delivered an inspiring speech that highlighted creating a level economic playing field for all Americans and reiterating how far the country has progressed since he took office. According to a CBS poll, 91% of Americans approved of the President’s State of the Union proposals, but as usual, Republicans railed against Obama’s speech. It was interesting to listen to the Republican official response to see if they conjured up some new approach to governing, but first one had to come to grips with which country Indiana governor Mitch Daniels was pontificating about.

    As for the general election of 2012, we have already been repeatedly warned that it will be close due to the economy, and it has been left at that. It is a mantra that too many of us sheepishly agree with. But, come to think of it, wasn’t it the Republican Party who brought upon this nation the worst recession since the Great Depression? Wasn’t it largely Republicans who deregulated our financial institutions, which brought us to our knees? And aren’t they now promising us more of that, and calling it “restoring America”?

    Yes, that was all brought to us by the Republican Party. And wait, there’s more…

    For the past three years, as most in the Democratic Party have attempted to save this country from a financial abyss while being fought tooth and nail by 99.9% of Republicans (plus 20% Republican-lite), we have observed how Democrats have had to argue and fight for benefits paid in and previously guaranteed to the American people. By now, we should see clearly which party is against jobs programs that would benefit the nation during these very difficult times. We really do know who saved the auto industry and all the jobs associated with it.

    We understand who got Bin Laden, ended the Iraq War, passed health care and financial reforms, is ready to cut defense spending and has indeed created jobs despite government job cuts at the state level. We have an inkling as to who proposed immigration reform, as well as a logical energy solution, and who opposed all such things.

    … and yet, “they” tell us that the election will be “close”?

    Two weeks ago, I launched a new Friday afternoon feature, highlighting the most offensive Mitt Romney falsehoods of the week. Last Friday’s installment was well received, so let’s keep this going with a third.

    1. “The president is planning on cutting $1 trillion out of military spending.”

    That’s a Romney favorite, but it’s not at all accurate.

    2. “This president has opened up no new markets for American goods around the world in his three years, even as European nations and China have opened up 44.”

    That’s not even close to being true.

    3. “We’ve got a president in office three years, and he does not have a jobs plan yet. I’ve got one out there already and I’m not even president, yet.”

    This one actually includes multiple lies.

    Newt Gingrich Campaign Admits Candidate Was Wrong On Claim About ‘Open Marriage’ Allegations

    Gingrich continued to insist that he offered witnesses to ABC. In a CNN interview Wednesday, he said that ABC’s claim that no character witnesses were offered was “just plain baloney.”

    But later, the Gingrich campaign admitted that the candidate was wrong. CNN reported Wednesday that after “persistent” questioning, spokesman R.C. Hammond said that the campaign only offered the speaker’s two daughters from his first marriage, who were both included in ABC’s story.

    As Greg Sargent put it earlier today, “Look, Romney is going to make the claims that Obama didn’t create any jobs, and that he made the economy worse, countless times between now and next fall. They will be central to his entire campaign rationale. Can we please start pressing him to justify it when he says this stuff?”

    That need not be a rhetorical question.

    The alternative is a further descent into “post-truth politics,” with a negligent media enabling liars every step of the way.

Obama’s warm and welcoming reception there yesterday must have kicked his voter disenfranchisement plans into gear. This is just disgusting and stupid.       First daughters Malia and Sasha Obama are studying Spanish and, President Obama says, they’re already “much better” at the language than he is.

      Asked in an interview with Univision whether he’s been practicing his Spanish, Obama turned the attention to his daughters. “You know, I have to say, Malia and Sasha are both studying Spanish,” he said, according to a transcript of the interview. “And already they’re much better than me.”

      “What I’ve told them is that my biggest regret was not studying Spanish hard enough when I was in high school,” he said. :Hopefully, they’ve got head start on me. And they’ll be entirely fluent. So they maybe will translate for me the next time I’m out.”

      But then, after interviewer Maria Elena Salinas thanked him for the sit-down in Spanish, Obama spoke a little of his own. “Muchas gracias,” he said.
