The money quote from the section on the mandate: Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it.
Lawrence O’Donnell had a segment on his show on Tuesday that the mandate did not have that big of a bite in it. Maybe this segment is available to view. His segment was very informative.
We will deal with any situation that comes up, whatever the decision…even though it is outrageous that this bill was even sent to the SCOTUS to begin with. If the mandate is declared “unconstitutional”, there will be a massive backlash. We have to remember that our president TAUGHT Constitutional law!

Hi All at TOD!! I have been lurking here for a while but decided today is a great day to say hello to all of you and your dedication in supporting PBO and all the great things he is doing to make take this country confidently into the 21st century. Today is a GREAT DAY!! I am a registered nurse and know the importance of the ACA law as setting the right direction to reform health care and improve health care provision. AWESOME!!!
Hey TOD. Been missing from you for a bit. Was not pleased with some past aspects, which shall remain with me for now. Just wanted to spread the joy to all PBO supportive sights. My prayer this morning of old ways dying off came true. As Curtis Mayfield sang….” We’re a winner, and never let anybody say….we can’t make it, cause a feeble mind is in the way…”. Big big win for PBO. I am so damn sappy happy right now. Signing off again. Peace to all.

In a victory for President Obama, the Supreme Court decided to uphold his signature health care law’s individual mandate in a split decision, upending speculation after hostile-seeming oral arguments in March that the justices would overturn the law. The mandate has been upheld as a tax, according to SCOTUSblog, with Chief Justice John Roberts joining the liberal wing of the court.
Twenty six states sued over the law, arguing that the individual mandate, which requires people to buy health insurance or face a fine starting in 2014, was unconstitutional. Opponents cast the individual mandate as the government forcing Americans to enter a market and buy a product against their will, while the government countered that the law was actually only regulating a market that everyone is already in, since almost everyone will seek health care at some point in his or her life.
Before oral arguments in March, polls of Supreme Court experts and scholars showed that most believed the mandate would be upheld as an exercise of Congress’ power to regulate interstate commerce. But after justices seemed deeply skeptical of the mandate in oral arguments in March, the consensus flipped, with most experts guessing the court would strike down the law.
House Republicans have vowed to repeal the entire law, though it’s unlikely the Democratic-controlled Senate would let that happen.
I don’t know were to begin.I am so happy I am crying, shaking,I am honestly falling faint right now.I’ve been praying for weeks and the closer we got to Today, the more nervous I become and last night I didn’t sleep.Needless to say I am feeling all kinds of sick and probably need to lay down but I am so incredibly happy and feel so grateful that this was upheld.I won’t need to worry about facing so many surgeries anymore and I am so happy for those who will also benefit from this as well
