Reuters: The Supreme Court on Wednesday will consider whether to strike down a key provision of a federal law designed to protect minority voters.

During the one-hour oral argument, the nine justices will hear the claim made by officials from Shelby County, Alabama, that Section 5 of the Voting Rights Act is no longer needed.

The key issue is whether Congress has the authority under the 15th Amendment, which gave African Americans the right to vote, to require some states, mainly in the South, to show that any proposed election-law change would not discriminate against minority voters.

Steve Benen: Defense Secretary-designate Chuck Hagel will take the oath of office later today, which will likely be a satisfying resolution to a difficult confirmation process. But before he’s sworn in, Senate Republicans issued one last challenge to their former colleague…..

… This has to be one of the more amusing things I’ve heard from Senate Republicans in quite a while. In effect, the line from the GOP minority is, “We smeared Chuck Hagel, we questioned his patriotism, we questioned his loyalties, and we accused him without proof of having ties to America’s enemies. Now that he’s confirmed, we expect Hagel to start mending the relationship we destroyed on purpose as part of our partisan scorched-earth campaign.”

Even by Republican standards, this is pretty nutty.

Greg Sargent: How’s that GOP “makeover” going? Not too well, according to the internals of the new NBC/WSJ poll. If these findings aren’t enough to persuade Republican strategists that the party needs a rethink on the issues — and not just a change in tone and packaging — then it’s hard to imagine what will.

The poll finds that Democrats hold a double digit lead over Republicans on many major issues facing the country — and finds solid majority support for key initiatives on Obama’s second term agenda. Dems hold a 22 point advantage on looking out for the middle class; an 18 point advantage on dealing with Medicare; a 16 point advantage on health care; a 15 point advantage on reducing gun violence; a 14 point advantage on Social Security; a 10 point advantage on energy policy; a seven point advantage on immigration; and a three point advantage on the GOP signature issue of taxes. (Republicans prevail on the deficit, spending and national defense)…..

TPM: After nearly a year of resistance that has damaged them politically with women voters, House Republicans have found a clever way to back down on the reauthorization of an expanded Violence Against Women Act, aides confirmed to TPM late Tuesday.

The original plan was for the Republican majority in the House to pass its version of the Violence Against Women Act reauthorization and then go to conference conference committee with the Senate. The Senate has already overwhelmingly passed a more aggressive bill, with protections for LGBT, Native American and undocumented women that have been at the heart of the dispute with House Republicans.

But all that changed Tuesday night. The Rules Committee instead sent the House GOP’s version of the Violence Against Women Act to the floor with a key caveat: if that legislation fails, then the Senate-passed version will get an up-or-down vote.

WH.gov: Clinton, Mississippi (3:0 EST): First Lady Michelle Obama will join TV personality and child nutrition advocate Rachael Ray to highlight the new healthy school lunches that are now being served across the nation. Thanks to the bi-partisan Healthy, Hunger-Free Kids Act, championed by Mrs. Obama and Ray, and signed into law by the President in 2010, the 32 million students who eat lunch provided by their school are now seeing more fruits, vegetables, low-fat or fat-free milk varieties, and whole grains; less saturated fat, trans fat, and sodium; and proper portion size on their lunch trays. Mrs. Obama and Rachael Ray will host a cooking competition between school chefs to highlight the new healthier school lunches. This portion of the visit will be pooled press and will also air on The Rachael Ray Show on March 11.

          I will never forget when President Obama had this campaign event, was it in Iowa or Ohio, and there was about 14,000 folks there and some seats were empty and that is all Chuck Todd talked about, the empty seats he saw. Never mind no one was coming to Mitt Romney’s events. But Todd never mention that.

    I so love Iowa in the winter. Weather forcast was for less than 1 inch of snow. So far since yesterday morning we have had 10 inches and its STILL SNOWING. Snow blowed my driveway twice and slid into and knocked down the “Yield” sign on my corner. Really someone could sell me real estate anywhere warm right now for just about any price!!

      Made it half way up my driveway yesterday—(Illinois)—-and then slid backwards, brakes useless, did a whirlygig on road before coming to rest with back end of car firmly in steep ditch. $75 tow charge plus tip plus whatever damage to underthings of car to be determined later. First year in many years we are not in Fl. visiting mom and sister at this time Bad decision to not escape this horrible month in the midwest.

I am looking through the window, trying to decide if I should go clear the edge of the driveway now or later. The driveway snow is slush-y so I suspect I’ll be able to drive over it but the town’s snowplough has created a barrier that I doubt I’ll be able to get over, especially if it hardens. Thing is, I don’t really feel like it right now…..maybe later. I figured I’d have to pay for the snow-less December-January (didn’t know Japa was bemoaning) but was hoping I’d be wrong.

    Watching the Hagel address and so far so good. He’s measured, calm, looks at the world with a clear eye and not a cold war mentality. Believes in team work both at the DoD and on the world stage and is interested in making sure the men and women of the DoD, military, and veterans are given the respect they deserve and get the benefits they have earned.

    My view on the VRA. I think it could be found to be unconstitutional as it is biased against certain localities (I am not a constitutional scholar but am imagining the argument). Therefore, I think it should be expanded so that all localities must submit changes in electoral process to DOJ, including all redistricting plans. I also think I should win the lottery. Odds of either happening are about the same.

        I think the Supreme Court has been waiting for this opportunity. Afterall, they just reaffirmed the Act 6 years ago…they could have refused to hear it. They’ll leave it to Congress to make the necessary adjustments. Remember, Scalia parties with Koch, Thomas and Roberts have already expressed their feelings. I will be shocked if they uphold it…but I’m praying they do.

      SCOTUS is, in my mind at least, the number one reason why we MUST win the Whitehouse again in 2016. It’s only when we have a SCOTUS that honors diversity, the establishment clause, and voting rights that we can feel good about returning a just democracy to our country.

      Actually, yes. The civil rights legislation was passed by a coalition of liberal Dems and Reps. The Civil Rights movements caused the Dixiecrats to move en masse to the GOP, as part of a plan by Nixon to forge a dominant Republican coalition. The GOP that exists today isn’t the one that existed 40 years ago. Hell, it isn’t even the one from 20 years ago.

      Nixon was for Civil Rights until after the decimation of the 1964 elections and he saw a path to victory through his Southern Strategy. It was a sen from IL, I don’t remember his name…..a GOPer who helped LBJ get the numbers needed to pass the bill.

    It is important to remember that the VRA was basically instituted to protect the right of AAs to vote, that protection now needs to be extended to other groups as well including Latinos, Native Americans, the poor, etc.

      That protection has always been extended to all minority groups from its inception. The NAACP has fought side by side with other minority organizations to make sure their voter rights are not infringed upon. The VRA has always been understood to protect men and women of all stripes.

        I know that, and I am not saying it explicitly stated taht it applied only to AAs. It is just that the sense at thwe time was that it was specifically enacted to ensure AAs the right to vote without being obstructed. Other groups were not a primary emphasisi. Now, however, we need to look at all groups and the fact is that many areas not included in the act are working ahrd to limit voting rigths for those other groups, which is why I think it should be expanded to cover the entire country.

    Only giving white people the right to vote, and forcing black people to give up their seat in the front of the bus, so that a white person can have it, doesn’t reek of “racial entitlement” at all! Racists sure are good at projection.
