Emily Atkin: BREAKING: The Supreme Court Will Allow Coal Plants To Emit Unlimited Mercury
Power plants will continue to able to emit unlimited mercury, arsenic, and other pollutants thanks to the Supreme Court, which on Monday invalidated the first-ever U.S. regulations to limit toxic heavy metal pollution from coal and oil-fired plants. In a 5-4 ruling, the Supreme Court struck down the Environmental Protection Agency’s Mercury and Air Toxic Standards, commonly referred to as MATS. The EPA had been trying to implement a rule that cut down on toxic mercury pollution for more than two decades. But the Supreme Court majority opinion, written by Justice Antonin Scalia, said the EPA acted unlawfully when it failed to consider how much the regulation would cost the power industry before deciding to craft the rule.
“EPA must consider cost — including cost of compliance — before deciding whether regulation is appropriate and necessary,” the opinion reads. “It will be up to the [EPA] to decide (as always, within the limits of reasonable interpretation) how to account for cost.” The decision doesn’t mean power plants will never be subject to regulations on toxic air pollutants. Instead, it means the EPA will have to go back to the drawing board, and find some mechanism to consider how much it will cost the power industry. Until another version of MATS is approved — a process that often takes years — power plants will have no limits on their emissions of mercury, arsenic, chromium, and other toxins. In other words, the rule is effectively delayed.

Yeah, I’m seeing hand wringing over the coal plant ruling. TBH, I don’t see it as unreasonable for the EPA to consider costs. It was a very narrow decision, which the EPA can rectify.

Supreme Court blocks Texas abortion-clinic rules
The Supreme Court is refusing to allow Texas to enforce restrictions that would force 10 abortion clinics to close. The justices voted 5-4 on Monday granting an emergency appeal from the clinics after a federal appeals court upheld new regulations and refused to keep them on hold while the clinics appealed to the Supreme Court. The Supreme Court order will remain in effect at least until the court decides whether to hear the clinics’ appeal of the lower court ruling, not before the fall.
Maybe old Tex-ass could open a few vasectomy clinics, so the guys can take some of the responsibility off the women. It’s always on the women, ever since Eve.

Would you kindly let them know that I asked you to tell them that my son had his surgery today, they found lung cancer and removed the entire right lung, and we are hoping testing of the lymph nodes shows negative (after a 5-7-day wait on the results). In the end it may be that such an accident meant that a crucial time in the Iran Deal negotiations, may have resulted in preventing the media from chronicling his every movement and interaction. In the end this may have provided a chance for a reduction in media scrutiny and hyperventilating;
I can not help but note that the seismic domestic events of the past days have taken the eyes of the media from the moment by moment reporting about the Iranian Deal - you know a majority can only focus on ONE subject at time ;
tomorrow (or very soon) we may wake up with the huge announcement that the Iranian Deal is done and agreed to by the P5+1
The media has much difficulty in multi tasking linda - so they concentrate on issues they think PBO will lose. It seems there could well be a win coming up on the Iran deal, given there is so little being discussed. Last time there was a “deadline” the media was so full of what would happen if it wasn’t met - seem to be ignoring this one.
