A few thoughts on “not good enough”-ism

If you haven’t read The Obama Diary’s call out to Shaun King (here and here), you really should.

Shaun King has been passionate about the horrors occurring in Ferguson. I don’t fault him for that. I actually laud him for his efforts to keep a light shining on something too many Americans want to have swept under the rug.

The crux of Chip’s open letters to Mr. King was that his attacks on President Obama were not helpful to the larger cause. That they were shortsighted. That they were unfair. That they were, at heart, dishonest. They certainly seem to be done as a pro-forma exercise. Pres. Obama always has to be criticized, as not being “good enough”. (The book I’ve been hawking for 2 weeks, “Against Football” by Steve Almond, descends in its final chapter to such an attack on the President.)

It’s the “not good enough” which kills the progressive movement. It’s the “not good enough” which destroys social justice.

Another piece you should read is one by Twitter warrior ReignOfApril. President Obama Is Not Our Savior is a slap to the face of every disappointed lefty who feels that every “failing” by this president is a betrayal of deeply held hopes.

The problem is that these hopes were of their own making.

Washington Post: Obama Judges Tip Appeals Court To Democrats

When President Bush II left the White House in 2009, the 13 U.S. courts of appeal were firmly under Republican appointees’ control. Ten appeals courts had majority GOP judges, two were evenly split and only one had a majority of Democrats. President Obama’s 49 appeals court appointees have dramatically altered the landscape. As of the Senate’s recess on May 23, nine of those courts had majority Democratic appointees and four had Republican majorities.

(There are 10 vacancies in the circuit courts. One Obama nominee is awaiting a Senate vote and three nominees pending in the Senate Judiciary Committee.) The change, much feared by Republicans, is not necessarily shocking. But the transformation, in just 5 1/2 years, said University of Pittsburgh law professor Arthur D. Hellman, an authority on the federal circuit courts, marks ”a huge shift in a very short period of time.” And it means that Democratic appointed judges “have the ability to control every important case if they wish to” in those nine circuits, he said.

Timothy B. Lee: Obama Has Secured Democratic Majorities On Most Federal Appeals Courts

A president’s Supreme Court nominees get a lot of attention, but presidents shape less visible parts of the judiciary too. Barack Obama is no exception. The Washington Post has a chart showing how the president has changed the composition of the nation’s appeals courts over the last five and a half years: Now, it’s important to say that courts are not supposed to be partisan institutions.

Still, Democratic judicial nominees tend to be more liberal than Republican nominees. And so the growing number of Democrat-appointed judges in our appeals courts will push American jurisprudence to the left on a wide range of issues. And because Obama’s nominees will stay on the bench long after Obama leaves office, these nominations will be one of his most durable legacies.

When it gets to be too much

 

Yesterday, the House voted to provide subsidies for summertime children’s lunches only to “rural areas”. That wasn’t even a dog whistle, it was an out and out statement of racism.

A few days ago, a New Hampshire police commissioner not only called President Barack Obama a “n***er”, but defended his statement, saying that the President fit his definition for one. He refused to resign until just a couple of days ago.

Today, Mark Cuban admitted to “biases”. He could cross the street—in what I’m sure is a gated, nearly all-white community—if he saw a young black man in a hoodie coming towards him. Of course, if that young black man in a hoodie had a 42-inch vertical leap, I’m sure he’d take the time to sign him to a contract.

It seems as if the past few weeks have seen an explosion of insanity. As Pres. Obama succeeds in the face of unparalleled obstruction—Obamacare, the economy, isolating Russia—certain sectors of this country have decided on a scorched earth policy. If they can’t exercise untrammeled power, if the country elects and re-elects Pres. Obama, then burn everything, like Russians retreating before Napoleon.

It can be forgiven if one gets to feel downtrodden. The forces arrayed against progress are not minor. They have almost unlimited funding. They drive media narratives. They more or less own five Justices on the Supreme Court. The scenario would prove daunting and depressive to even the hardiest souls.

TPM: Justice Department To Launch Push For Full Recognition Of Same-Sex Marriage

In an assertion of same-sex marriage rights, Attorney General Eric Holder is applying a landmark Supreme Court ruling to the Justice Department, announcing Saturday that same-sex spouses cannot be compelled to testify against each other, should be eligible to file for bankruptcy jointly and are entitled to the same rights and privileges as federal prison inmates in opposite-sex marriages. The Justice Department runs a number of benefits programs, and Holder says same-sex couples will qualify for them. They include the September 11th Victim Compensation Fund and benefits to surviving spouses of public safety officers who suffer catastrophic or fatal injuries in the line of duty.

“In every courthouse, in every proceeding and in every place where a member of the Department of Justice stands on behalf of the United States, they will strive to ensure that same-sex marriages receive the same privileges, protections and rights as opposite-sex marriages under federal law,” Holder said in prepared remarks to the Human Rights Campaign in New York. The advocacy group works on behalf of lesbian, gay, bisexual and transgender equal rights.

On Monday, the Justice Department will issue a policy memo to its employees instructing them to give lawful same-sex marriages full and equal recognition, to the greatest extent possible under the law. After the Supreme Court decision last June, the Treasury Department and the IRS said that all legally married gay couples may file joint federal tax returns, even if they reside in states that do not recognize same-sex marriages. The Defense Department said it would grant military spousal benefits to same-sex couples. The Health and Human Services Department said the Defense of Marriage Act is no longer a bar to states recognizing same-sex marriages under state Medicaid and Children’s Health Insurance Programs. The U.S. Office of Personnel Management said it is now able to extend benefits to legally married same-sex spouses of federal employees and annuitants.
