Like most men I’m barely competent when it comes to understanding a woman’s body, so I’ll be damned if I’m going to get up anywhere and tell a woman what to do with her body.       It is more than the truth even in TX, as of 2002, Dems registered to vote out numbered the GOP. Yet since 1998/2000, no Dem hold a statewide office in TX.

      The problem is lack of information and Dem political activity lacking in the 50 states.

    Since Hobby Lobby no longer meets the requirements under the ACA , does this mean the employees can now go on the exchange and get coverage with subsides ?

    It is my understanding that if your employer meets all the requirements a person cannot get a subsidy on the exchange.

    A major part of the majority’s opinion in the HL case rests on this:

    The Hahns and Greens believe that providing the coverage demanded by the HHS regulations is connected to the destruction of an embryo in a way that is sufficient to make it immoral for them to provide the coverage. This belief implicates a difficult and important question of religion and moral philosophy, namely, the circumstances under which it is wrong for a person to perform an act that is innocent in itself but that has the effect of enabling or facilitating the commission of an immoral act by another. Arrogating the authority to provide a binding national answer to this religious and philosophical question, HHS and the principal dissent in effect tell the plaintiffs that their beliefs are flawed. For good reason, we have repeatedly refused to take such a step. See, e.g., Smith, 494 U. S., at 887 (“Repeatedly and in many different contexts, we have warned that courts must not presume to determine . . . the plausibility of a religious claim”)

    The problem here is that Alito is focused on the belief that it is immoral to facilitate an immoral act by another. It is this belief that he says the Court cannot call flawed. But the key belief here is the one held by HL that the BC in question is connected to the destruction of an embryo.
    Now this is a belief that can be called into question, as this can be determined by empirical fact. The whole basis of the HL argument is based upon a false belief to begin with.

    In other words, even if one accepted the argument that a closely held for-profit corporation has religious rights, the FACT that the BC in question are not abortifacients, negates the rest of the argument.

      We have turned over our entire existence to the primacy of anyone’s ‘belief’ if they are in a position to exert that belief over fact.

      You want to believe in fairies and whatever, fine. When your belief trumps reality, it should be a screaming red flag to anything that resembles governance and a functioning society.

      Even some of the idiots have to see the dangers of such implications.

      But five Supreme Court Justices who don’t like abortion, have no problem with this reasoning. It. is. terrifying.

      That being said, it is more than that: it is a vehicle to extend ALL rights of any kind to corporations, regardless of the rights they trample.

      Every founding father is rolling in his grave right now.

      Today when a Family denies an under-aged child some life saving modern medications, the state is allowed to intervene. Those working for HL are adults not minor children. This ruling is bastardy wrong.

      They have NOT only allowed a Vote. They have refused to govern, period. There are Zero meaningful bills so that both chambers can go to conference. That is an abdication of duty.

      Perhaps, those citizens whose families are individually affected can Sue the Brains off Boehner? Nope. Congress as a body can not be sued. But the Rehnquist Court made it OK to sue a president currently serving.

    I should be losing some relatives and friends over what I’m posting and sharing on FB today. I’ve been respectful of the “My God should be everywhere” b.s., and tried to have respectful conversations (my nieces and nephews have called my arguments ‘brilliant’ because I did not ever insult or belittle their aunts and uncles). But today, I will not be silent. We cannot let the Religious Right and their corporate enablers invoke Christian Sharia law on this land.

      I am Roman Catholic. I will not equate the Christian Faith with the Sharia Law on this ruling. Why?

      It doesn’t exist in US.

      We have seen the Christian influences and the Courts weirdly creeping these religious beliefs into our laws. No way the SCOTUS would have ruled in favor by 5-4 has any other religion brought this case……No way, No How, Zippo.

      Using the Sharia Law independently to make a point I get it…..the invocation and linkage of both is a tad unsettling. I am only pointing out how I feel. It is not a criticism of the post.

        My point is an analogy: where religious beliefs become the governing force over secular society and a means of promoting one religion over another. I did not mean it literally – in fact Scalia used the exact opposite reasoning when deciding that American Indians did not have the right to place their religious practices over ‘general applicability”. Of course the RFRA was the result of that decision; and individual rights to religion were placed above general applicability, or at the very least, pitted the two against each other. And today, the welfare of the commons was sacrificed to the narrow religious views of some power corporate owners.

        We are not enacting Sharia law as is practiced in Muslim countries. We are heading toward our own version of it, that puts a particular right wing evangelical and conservative Catholic religious vision over the rights and privacy of the pluralistic society. This decision in particular is analogous – what these corporate owners ‘believe’ trumps actual reality. It is in the decision, specifically. The ‘rights of the owners of the corporation’ to their particular religious standard puts their First Amendment rights over the other participants in the corporation – the workers.

        As a practicing and believing Catholic, you are free to abstain from birth control, respect the marriage laws of your church and in any other way worship as you please. I will fight to the death for your personal right to do so. But religious beliefs in the position of power of an employer should not trump ‘general applicability. If we are not outraged, all the ideals upon which the United States are based will crumble.

        This is an incremental decision, based upon the incremental decision of Citizens United, and RFRA, which places a standard of individual personal belief over the welfare of the commons. No one is forcing anyone to take birth control. No one is forcing anyone into having an abortion. But since the Hyde Amendment, ‘incremental’ laws have been passed that make the practicality of exercising an individual’s right to abortion virtually meaningless. And now it is starting with birth control – something that was ‘decided’ 50 years ago. And this direction is now empowered by today’s decision and will incrementally erode any number of other rights.

        The exclusions in the decision are particularly egregious – they carve out women’s private health care as frivolous and subject to the ‘belief’ of the employer, even though FACT has proven that their ‘belief’ of abortafacients to be totally untrue.

        So their ‘belief’ trumps the truths and the rights of millions. This is NOT religious freedom – this is actually religious persecution of everyone else. This is the definition of the effect of Sharia Law – which was the point of my analogy.

    We Will Have His Back all the way. Frustrated, of course why wouldn’t he be at this point? However, President Barack will Not give up. He is a fighter for the people. He will continue to call this as he sees it and as we who support fairness to the people. The TP people have taken Speaker Boehner to a place that is plain hellish, IMO. This does not rest well with a mind as brilliant as PBO. Nor does it rest well within his core.

    These people are self-centered fools who have daily taken this country to a place where no person in their right mind would want to go. I will not apologize for speaking the words, “he seems frustrated,” because PBO has already told us that he is frustrated. People Do Not Listen to PBO. They see him come out to speak(how many times did we see W come out and tell the American people what was going on?) and before he barely gets into his opening remarks, they are writing their negative headlines for their ugly papers.

    So, what shall we do? We keep moving FORWARD with PBO and VPBiden. All the way. We get people out to vote. We talk to people and remind them of what this Congress has Not done to move the country forward. And we remind people what This Congress has done to move the American people Back. No, we will Not continue to allow this sorry ass Congress to blame PBO. We will frustrate them. We Vote, We Vote in 2014, and we get out our check books and support when we get the call from PBO, Nancy, VPBiden, Plouffe, Carson. Let us frustrate the GOP asses.
