    He continues to set a premiere example for us: showing up for jury duty with a big smile and handshake! I think I counted six on his SS detail…did I miss someone? He was smiling, they were serious. Is it possible to admire him more???

    Good evening TOD! For me, the best thing about the results last night was the number of women who ran and won. It was so depressing to see the amount of misogyny against Hillary last year, made me wonder if I knew this country at all. After fighting my whole life for women’ rights, it seemed totally futile. Today I have HOPE again! Makes all the difference:-) Onward to 2018.

    BTW, no trial attorney in his or her right mind would ever select PBO for a jury:-) And not because of the distractions–they would fade away once the trial started–but because he would have too much influence on the other jurors. Essentially you’d be down to a jury of one, good if he sides with you, bad if he doesn’t. I once dismissed a first year law student for essentially the same reason, was afraid she’d have too many arguments to sway the other jurors, and 1Ls think they know far more than they do:-) A few years later she applied for a job on my team and reminded me of the incident. Said she was so disappointed, which I figured at the time. I did hire her:-) In any event, you never want one person to have too much sway with the other jurors.

      I’ve been on exactly one jury panel, so am no expert, but two people in our group of 12 were both retired — a Navy Admiral and a man who had been Attorney General in Connecticut (so long ago, don’t remember their names now).

      I thought they’d be recused, but the only people who were dismissed were people with medical knowledge, such as nurses, EMTs, etc. (no doctors were part of the jury selection process, but I’m certain any medical doctors would have been dismissed by the defense too).

      I’ve mentioned this case here before — it was an obstruction of justice charge, for a 21-year-old kid who was hanging out on a sidewalk in Ojai CA after having an argument with his girlfriend. He was built like a football player, about 6’4″ and was approached by 2 sheriffs, both of whom were about 5’7″ — he made the mistake of pushing a flashlight shone in his face by one officer, and the other jumped him from behind using a chokehold (which I thought was illegal), causing him to fall and injure his face (hence no one with medical experience on the jury panel).

      It was such a ridiculous charge, but I think the sheriffs were trying to save face (or not have to pay for the defendant’s medical bills?) and so they slapped the “obstruction of justice” charge against him — even though he was never under arrest.

      We were a hung jury because one woman who seemed reasonable during the selection process folded her arms and declared that “police can do no wrong.” No swaying her, so that’s the result we gave the judge (10-2 for acquittal because that woman managed to convince another juror to vote guilty too).

      Saw news reports today that Oprah was selected as a juror for a murder trial in Chicago, so some celebrities do become jury panelists.

      P.S. We selected the Navy Admiral as our foreman, not the Connecticut AG. And everyone in the courtroom was white, except for me and a Latino man on the jury.

        I am surprised the attorney was on the panel Arapaho. It is always a balancing act and you’ve got only so many peremptory strikes which means you usually end up with a struggle on using your last one 🙂 I remember with the law student there was another juror that I would have liked to strike as well but ultimately decided that the law student was the one that needed to go. I don’t believe I was wrong in that decision as I won that case. More importantly, as 1 L she was anxious to use and show her knowledge. but there can be other factors as well as in your case with medical personnel. The trickiest part in jury selection is that inevitably you will have some jurors who will conceal knowledge. For example, the woman that hung your jury would have been stricken for cause had she made her position known during voir dire. She should never have been allowed on that jury. Oftentimes you just end up relying on your gut instinct as to whether a particular juror is concealing information or will have too much influence. All that said, President Obama would never be allowed on any jury 🙂 He can be a master of persuasion and would simply exert far too much influence even if he tried to hold back.

          Thanks for the info. I was surprised when the retired Connecticut AG was allowed to sit on the panel — many people have said to me that they’d never be selected for a jury because they (or their spouse) was a lawyer.

          I think you’re right that PBO would never be seated on a jury panel, but I think we both know that his inclination would be to listen, and only offer an opinion if the jury became contentious and began yelling — I don’t know how “real” jury panels handle it (I don’t consider the one panel I’ve sat on as real — there was no actual “crime” involved). In our short deliberation for a day, tempers definitely flared.

          As for the woman who was adamant that “police can do no wrong” — she didn’t offer that opinion during jury selection, even though the two questions that the attorneys had were: 1) Medical knowledge (immediately recused by defense) and 2) If you or a close family member had ever had experiences with police.

      I was excited that I received my book yesterday. I haven’t unwrapped the plastic yet… almost want to preserve it like a collector’s item; as if opening it will diminish the value. But I know that what makes it valuable are the photographs inside and the reason I purchased the book was to look at and cherish and smile about those photos and the stories behind them.

      i also know that once I remove the wrapping, it won’t be a quick flip through. I want to make sure I have time to savor each and every photograph and reminisce about a President and a Presidency that made us proud.

    What glorious outcomes in so many of yesterday’s elections. So happy for all of the democrat wins, and so many by women and POC. How awesome. Made me feel hopeful for the US for the first time in a very long time. I truly hope that more democrats are finally realizing that voting in EVERY election is imperative if they truly want to see any change. It’s also interesting of course that Virginia used paper ballots. I was worried about whether we would see a repeat of 2016’s Russian interference, or whether hackers are lying low for now given all of Mueller’s ongoing far-reaching investigations.

    It’s also been hilarious to see people so excited about PBO reporting for jury duty! Hey, it’s no surprise. He is a true role model for so many people. He has stated repeatedly, forever, that the role of citizen is the most important role. He walks the talk, and always has.

    So today we see a photo of Donna Brazile standing with Sheriff Clarke, the guy who let his prisoners die for lack of water and forced a woman to give birth in shackles.
    She declares in her book that PBO has a “Titanic ego.”
    There’s also a passage from her book floating around that she thought HRC was lying about having pneumonia during the campaign.
    Tonight she appeared on Tucker Carlson to hawk her book.
    She sits on the Rules Committee of the DNC.

      When I saw the photo on Twitter, all I could say was, wtf?! What is her real problem/issue? what does she want? Is all of this for hurt feelings for imagined wrongs or what? Whatever her intent, she has ended any influence or respect that she may have had. She just seems rather sad and pathetic. So glad that many have shown that we can run for office and win without the DNC drama. If they ever get their act together, we could do even more, but we do not have time to wait on them: “we are the ones that we have been waiting for.”

        This is all so weird. I know she’s been around for a long time but I don’t know enough about her to understand her current mood. Her timing to come out swinging against Democrats and the structure at this moment is odd given the circumstances. It’s just very puzzling to me. Between the attention garnered by her and Sanders, it’s grossing me out. The MSM is dying to blow her story up.

          The majority of the country are frantic to get the orange menace out of the WH, and we should UNITE to get this done (along with Pence and the everyone else included in 20 indictments that await unsealing).

          I know very, very little about Ms Brazile. However in the spirit of a wannabe ‘conspiracist’ and in the light of her weird behaviour, I’m now wondering if Ms Brazile may have been the dem leaker (to Russia) and, given the way Mueller is moving, she’s now trying diversionary tactics to muddy the waters. Of course this is not a rational explanation, but hey, her behaviour isn’t rational! Plus, 😉 your linking her to Sanders reminded me that I’m convinced Bernie, grifting fraud that he is, has some Russia taint.

      I’ve seen a couple of the interviews she’s had. To me, there is a level of anger there at a *personal* level. Whether it is directed at the DNC, or at individuals like HRC, and BO, I don’t know. It may be anger that she’s being criticized and is having to justify what’s she said in her book and what she has said verbally. She does say that everyone is having their turn at telling their side of the story as it relates to the DNC and the 2016 election and she believes she has the right to tell her side.

      Personally, I think “her side” includes a lot of half-truths and partial information. She refers to herself as the clean-up woman; that she only gets called when things have fallen apart to a point that they can’t be easily fixed. She indicated that the DNC was basically bankrupt and that HRC had essentially bailed them out. Yet she gripes that in her role as acting chairwoman, she wanted to spend 8M on something, but only 2M was approved. That’s probably the sort of actions that got the DNC in the financial crisis they were in. But she seems to have taken it as a personal affront. I also wonder if she thought she should have been *given* the DNC chairmanship rather than the rank and file electing Perez. Does she resent him for that and is therefore, trying to make his job more difficult?

      If the recent elections this past Tuesday is an indicator, her antics (in the name of a making a buck) did not impact the outcome for Dems as negatively as many predicted that it would. It may mean that she is not as relevant as she once was and still believes she should be. Hopefully the 30 pieces of silver she makes from her book will help to pacify her.

She’s smart enough to know that a picture with Clarke is taboo and an that an appearance on Fox her the token speaking out against Democrats and feeding into the both sides meme. That she’s doing it anyway is like a FU to Democrats and the individuals that she continues to claim to be her friends. Just wondering the cause for the reckless behavior.

    Thank you to everyone who stepped up to run for office, knock on doors, make phone calls, donate, register voters, vote and get others to do so in the cities and states who held elections Tuesday. Thank you to Indivisible, Emily’s List, Moms Demand, the Women’s March,Jason Kander’s group and others who picked themselves up after 11/8/2016, dusted themselves off organized and went to work to save healthcare, protect immigrants, fight for equality, to stand up against sexual predators and to get the word out on the destructive things that the GOP and the deplorable ones in the WH have been doing to destroy so much of what makes life living. Our despair has hardened into resolve and the victories that the work of so many have brought about have allowed us to greet the anniversary of that dark day with hope and joy as we have been reminded of what “yes, we can” really means.

    Today, we had a local state election (like in VA and NJ) in one of the states, where they elect a chief minister (like your gov).

    The turnout was a record 74% for that state.

    Here’s how much real Democratic candidates don’t need Trump voters.
    Why did Ralph Northam win Virginia’s gubernatorial last night by nearly ten points? Black, Asian, and Latin voters, and especially black women.

    The lesson is when black voters show up, Democrats win and win BIG. We know this. What I don’t know why we’re trying to worry about winning back white men who voted for Republicans by a 27 point margin. Get more black votes out. Fight voter suppression. Jesus, it’s not multi-variable calculus, guys.

    Republicans know this lesson well and have been trying to disenfranchise black voters for decades exactly because they know black voters win election for Dems because we vote for Dems. Duh.

    Why some Democrats still yet don’t understand this, I’ll never know.

      Because the not-so-secret is that many white so-called liberals are racists who believe that the only time something has value and validity is when it comes from white people, especially men. This belief in the superiority of male patriarchy is one of the things that hobble the party. Black people know that we are being used, that we receive, only as an after-thought, the chitterlings, but we are pragmatic enough to know that filling up on the remains is better than starving. The Deplorable one asked us “what do you have to lose?” and we knew it was the little that we have. Democrats should not get it twisted; our loyalty is neither blind nor inexhaustible. We see and hear everything that is going on, the blatant actions and the dog-whispers.

        CEB, you are so accurate. “This belief in the superiority of male patriarchy is one of the things that hobble the party.” I’ve read many questions of why white women vote race over gender. I call this the “daddy’s girl” syndrome. I am white, so I can say this from the “inside.” White girls are brought up to attract men, and to believe that what is most worthwhile is what comes from their dad, or then their husband. They are taught that first their father takes care of them, then their husband takes care of them. Independence has not been the goal of white women until recently. My generation ( the silent one) had one goal: To GET a husband. We were sent to college to get an MRS degree…to get that education but, not particularly make use of it. So, they will vote for a white man over a white woman or a man of color, or for sure not a woman of color. Their whole lives are spent trying to impress that Perfect man.
        The poem “Patterns” by Amy Lowell pretty well captures the entire ethos of this upbringing and life.
        I was told not to show how smart I was because no man would want to marry me….if you can imagine saying that to someone. Fortunately, I met a man who wanted a smart wife and was not intimidated. How screwed up that was.

    On Monday, as the Department of Homeland Security prepared to extend the residency permitsof tens of thousands of Honduran immigrants living in the United States, White House Chief of Staff John F. Kelly called Acting Secretary Elaine Duke to pressure her to expel them, according to current and former administration officials.

    Duke refused to reverse her decision and was angered by what she felt was a politically driven intrusion by Kelly and Tom Bossert, the White House homeland security adviser, who also called her about the matter, according to officials with knowledge of Monday’s events, who spoke on the condition of anonymity to discuss internal deliberations.

    Duke, who was confirmed by the Senate in April, has informed Kelly she plans to resign, said the officials.
