      Even though this is a well established pattern in the United States, I still recoil every time I am confronted with the myriad ways in which we try to ignore, suppress, justify, deny, and now pressure a family to “get over” their loss/injustice/tragedy all so white people can move on and pretend that this is the greatest country in the world. Enough! We have been suffering too long in a country that cannot seem to reconcile the reality of structural racism, misogyny, economic injustice, etc with this mythology we have created about ourselves.

      What more do we need to suffer before we realize the cost of trying to “explain away” the structural racism that is a matter of life and death for our black and Native American sisters and brothers? Seeing the nonsense, disrespect, indifference, and hostility of too many white progressives is disturbing.

      One of the reasons I am so appreciative for TOD, is because this is an inclusive and honest community. This is a tremendous resource and refuge for compassionate people.

    It is NOT illegal to drive without a front plate. Plus, if I heard right, the plate was inside the car.

      Here in California it is, but when I lived in Georgia, it wasn’t illegal.
      And yes, he did have the license plate in his glovebox. It is clear from the audio on the video, that this officer was cruising for a bruising by the constant way he kept bringing up the drivers license situation. The Campus Cop escalated his own aggression and was truly in the wrong.
      A citation to have the plate put on in 30 days was all that was initially warranted. Then he could have cited the driver for having a open liquor container in his car and for not having his drivers license on him, BUT THAT’S ALL!

        The liquor bottle was not opened.

        That’s why he gave it to the cop to confirm for himself

        It hadn’t been opened and in fact, I think even the seal hadn’t been broken.

        Otherwise the cop would have asked him if he was driving impaired and he didn’t

          I couldn’t see whether it was open or not, but if it was, that could have warranted a citation. Regardless, none of the concerns should have cause the situation to end in death.

          In California only the highway patrol can site you for not have plates or parking division’s in cities if you are parked on public property, i.e metered parking, public streets, but not driving. If you are on private property without a plate or tabs, no one can give you a ticket. I was stopped by a police officer in Inglewood for not having my current tabs (just bought the car and had not received them) but he could not give me a ticket as a moving violation just a warning. Bastards only pulled me over to flirt….

      From my informants on Twitter from OH, it apparently is illegal to drive without front and rear plates. That’s besides the point, of course. That shouldn’t lead to a trigger happy school cop putting a bullet in your head.

    I just cannot with these murders. I feel sickened again and again and again. Every day it’s another person, just living their life, murdered in cold blood.

      I know meta and to everyone else whose eyes have been opened to decades of police murders and lies about deaths of minority men & women. We (in the AA and minority community) have known this to be the case, that police lie, police murder, and when they say “he went for his waist band” or “I feared for my life” it was a straight out license to get away with murder. Since the invention of the cell phone camera and Youtube we have found out the truth. It’s just that it’s too late for these racist cops they can’t shut off their hate to not get caught. People and in some cases the media is giving these reasons a 2nd look.

The individual in the car stopped him from opening the door, started the car, shifted to drive, and tried to steer out into the officer while taking off. I honestly think that this is just a witch hunt, the officer was polite, respectful, and simply asked the man repeatedly for 3 minutes to show him a license, which he refused.

    I wonder if the media would even make a peep out of this case if the officer had not shot, they had gotten into a high speed chase, and then this individual had run someone over and killed an innocent individual.”

      Hey Gail - I need more details on the SamD case, but it seems, from the little I’ve read, that the cop went over the line in trying to detain someone beyond a traffic stop.

      “After Officer Encina pulls her over, he has the right to resolve the issues of the traffic violation he observed. That’s through identifying her, and she cooperated in that. That’s through writing her the ticket, or the warning, which he was able to do. He ran her for any wants or warrants, and he returned and issued the citation.

      At that point, the question is, what’s his legal right to continue her detention? Why is he allowed to keep her there by the side of the road? So, the first problem that I see- and I’ve watched it twice, but I may have missed some details or intricacies- but I don’t know what exists at the point where the confrontation begins that allows him to continue the detention. Meaning, why is he allowed to keep her there? There’s no basis under the facts as seen in the dashcam video to order her to put out her cigarette. Then the question becomes, what happened there? What happened is, there’s a term we hear in the criminal law field- “somebody failed the attitude test.” And when somebody fails the attitude test, things escalate. Again, there is no “attitude test” that’s permissible as a basis for police encounters, meaning police officers don’t get to harass you because you have a bad attitude, or you don’t show them the proper deference.

      You see in that moment where he orders her to put out her cigarette, a breakdown in police training. Basically, being a police officer, you’re going to run into people having a bad day, not wanting to engage with you, not wanting to chat and not wanting to continue an encounter beyond the legally permissible scope of the encounter. And that’s what happened here. She’s allowed to leave at that point, and he’s like “hey put out your cigarette.” He has no lawful basis to order her to do so under the facts of this case. If she was doing something that was interfering with him conducting the traffic stop, the officer may issue a lawful order for her to stop doing that. But officers continue encounters with people smoking cigarettes all the time. She’s not doing anything unlawful, she’s not doing anything that increases the danger to the officer. But beyond that, the question becomes, why is he telling her that? Why is he telling her to put out her cigarette? What is his lawful authority to do so? Because his right to detain her ended the minute he was done with his traffic investigation and written the ticket or warning. At that point, the detention became unlawful. At that point, he is no longer acting in his capacity as a police officer, rather he is just a man in uniform harassing a woman stopped alone in her car by the side of the road.

      Again, this is where the Fourth Amendment controls the encounter. Once the investigative detention relating to the traffic stop was complete, he had no basis to detain her, no basis to order her to put out her cigarette, and no lawful basis to order her out of her vehicle.”

      What these white ass people don’t seem to understand is just because you may have done wrong in your life, it does not mean that it is okay for any police officer to be your judge and jury. What would Ms. Lilly White kelly have to say if it was a member of her her family? Kelly and those people at Fox are the kind of people who would say Emmit Till wasn’t so innocent.

      Thank you for bringing this article here Donna…it helps to explain much of the problems with the DNC…but it also give insight to what OFA will be after the President leaves office…it is truly exciting….

    Despite all of the rhetoric about the liberals threatening ALEC’s very existence, during lunch they touted their influence in state legislatures, the halls of Congress with 86 sitting members of Congress and 13 Senators former ALEC members, and even in the current Republican presidential primary, where four candidates, including Scott Walker, are former ALEC members.
