The Treasury Department maintains that it has no ability to pick and choose which bills to pay if it’s short of cash. According to the agency’s inspector general, its computer systems are designed to “make each payment in the order it comes due.” Full stop.
Under this view, if Congress fails to lift the debt ceiling, the U.S. government will only have money to cover about 65 percent of its bills. Some payments will simply fail to clear. Perhaps a payment to a defense contractor comes up short. Maybe a Social Security check bounces. Maybe an interest payment to bondholders fails.
That last possibility is the most worrisome. If the U.S. government misses a payment to bondholders, the consequences could be severe. “A default would be unprecedented and has the potential to be catastrophic,” warns Treasury. “Credit markets could freeze, the value of the dollar could plummet, U.S. interest rates could skyrocket, the negative spillovers could reverberate around the world, and there might be a financial crisis and recession that could echo the events of 2008 or worse.”
Other financial analysts agree. A missed debt payment could cause the entire financial system to seize up. “Let us be perfectly clear,” warns a note from RBC Capital Markets, “crossing the debt ceiling would be catastrophic.”

It’s getting to be that way, bc baby boomers are just so scared about debt. And they all vote , everyone of them.
Unfortunate but true.
Most baby boomers are like me - they spent 30 years of their lives buried in debt - and at a time when interest rates rose to 18%. It was my parents generation who hated debt - they saw their parents suffer the depression 1929-1939
So now I have just got out of debt, have some retirement savings which the GOP are about to plunder - big time. Any baby boomer who supports the GOP is not thinking with their brain.
As the spokesperson said, this is unsustainable, and will have to be paid back from Federal funds once Boehner steps up. This is like emptying the ocean with a beach pail.
$10M is not enough to fund anything. Besides, I don’t think this is the way to go. Repubs in Congress needs to fund the govt.

Thanks Bob for all your tweets alerting the DOJ about people threatening to do great harm to this country. While you are it, you may want to remind the DOJ, Democratic leaders in Congress and of course WE the people, about Section 3, of the 14th Amendment which applies to a great many Republicans in Congress, including John Boehner, Eric Cantor and Mitch McConnell. Here is what Section 3 of the 14th Amendment says:
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who having previously taken an oath, as a member of Congress, or as an officer of the United Sates, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof….”
Personally, I think Ted Cruz, Mike Lee, and all the teabag members of Congress who have instigated the shut down the government and are refusing to honor their constitutional obligation to pay the debts of the United States, as is required by both Article I, Section 8, and Section 4, of the 14th Amendment, are engaged in insurrection and rebellion against the Constitution and should be thrown out of office. The same goes for Congressional leaders who are giving them “aid and comfort.”

As you and everyone here knows, I’m not a lawyer. But, I can read and can analyze risk and harm quite well. These folk are doing real harm, every second that they threaten in any way the good faith and credit of the United States of America.
They have to be stopped. Hopefully, the DoJ will act before calamity hits the global economy.

Okay, here comes my crazy analysis. :) I don’t think we actually reach the debt ceiling on the 17th, or perhaps what I should say is the government won’t be out of money. I remember seeing Lew on a financial show and he said we’d reach the debt ceiling in early November. I also recall him saying recently that if the Republicans refused to raise the debt ceiling he would perhaps be forced to break the law.
My interpretation: the government will not be out of money, the law just forbids disbursing funds above the present ceiling. If Lew pays all the bills anyway, what are the Republicans going to say…we’re going to lock Lew up and impeach Obama because they didn’t let the country go into default? Does this plausible to anyone else?

I don’t agree. To my understanding, the 14th Amendment allows payment of debts incurred in the event of insurrection. The Insurrection Act defines insurrection as a violent rebellion that requires the President to employ troops. Of course, there have been a million laws written to the North and South of both, so anything is possible.
The language of the 14th is much broader than that, FayPax.

FayPax, here is exactly what Section 4, of the 14th Amendment says:
“The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any state shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.”
The plain reading of this amendment clearly says that all U.S. “public debt, ” which has been “authorized by law”… “shall not be questioned.” The only the debts exempted are debts incurred in aiding insurrection/rebellion or claims about the loss as a result of the freeing of slaves. I am not familiar with the “Insurrection Act” you are referencing, but I would appreciate getting more information from you about it.
My only reservation is that I don’t see how the President can legally invoke the 14th Amendment to defy Congress. Section 5 of the 14th Amendment clearly states: “The Congress shall have the power to enforce, by appropriate legislation, the provisions” of the Amendment. No where in the Amendment is the President given power to enforce Sections 1-4 of the 14th Amendment without Congressional authorization.
Thanks Nath. Sometimes, I am not as clear as I should be. It isn’t that I disagree with you or Bob, for I am certain both of you are far more knowledgeable than I, but I tend to rely more on how I believe the Constitution will be interpreted by our activist Supreme Court. These justices have ignored precedent, Congress’s duty to regulate and secure the economic welfare of the nation, and the Constitution in favor of a majority ideology that is entrenched in the Articles of Confederation.
Revisiting their debate over the healthcare law, I found it interesting that they deemed the Merchant Marines Mandate “too old and outdated to be applicable today”, but when it came to immigration had no problem reaching all the way back to the caverns of abolitionists to fashion an interpretation.
In determining what the President’s response should be, I think many forget how limited his power actually is. Legislating is the province of Congress. Despite the clamor for the President to act, or influence, the truth is, under the Constitution that is not his duty. It is to enforce the laws enacted by Congress, as you so clearly point out.
The 14th Amendment was enacted because of the Civil War and slavery, which gave way to insurrection. I would expect this “state’s right” Supreme Court to interpret it with that in mind.
The Insurrection Act is what President’s use when they call out the National Guard. My “guess” (can’t remember and too lazy to look it up) is the Act was an offshoot of the 14th Amendment. It would have been a right assumed during the Rodney King riots, Katrina and Operation Wall Street…events where masses of people express discontent.

instead of POTUS violating the debit ceiling so that the extremists can use that as a justification to impeach him, I have a tentative suggestion.
I don’t know if it is possible to go after the constitutionality of existence of the debit ceiling its self and permanently nullify its existence through litigation.
is it possible for the White House or DOJ to urgently sue (in DC Federal court or wherever) to demand that the debit ceiling be ruled unconstitutional?
Basis for unconstitutionality would be because of the threat it posses to the “full faith and credit” of the government;
if it is declared unconstitutional then the debit ceiling will become permanently moot as a tool for this extremist congress and others that follow.
Nullification of the debit ceiling would eliminate any future blackmail. result would be like permanently taking matches from the hands of legislative arsonist.
